When you encounter disputes in securities investments or futures trading that cause damage to your own rights, besides initiating litigations through civil proceedings and seeking court judgments. Investors may also recourse to mediations through impartial mediation institutions to avoid participating litigation proceedings, which may cause mental and physical exhaustion. Mediations may effectively reduce the source of litigation.

SFIPC sets up a mediation committee in accordance with the Securities Investor and Futures Trader Protection Act. The committee is designed for handling mediation matters concerning civil disputes of securities investors or futures traders. When investors encounter civil disputes, they may fill out a mediation application form and apply for mediation to SFIPC.

When both parties reach an agreement in a mediation case, the mediation will be deemed succesful. The mediation committee would prepare a document based on the mediation results and submit it to the court for approval. A mediation ratified by a court shall have the same force and effect as a final and unappealable civil judgment. In addition, for a civil action pending in court, where mediation is successfully concluded prior to the issuance of a final and unappealable judgment and the mediation agreement is ratified by a court, the action will be deemed withdrawn from the time of the mediation's successful conclusion. In this way, not only would the cumbersome litigation process be avoided, but disputes may also be resolved effectively.

Application method
1. Description:

To apply for a mediation with SFIPC, investors may download the "Mediation Application Form" from our website and fill it out according to the specified format (including signature or seal). Please attach relevant evidence, documents, or files and mail the documents to: 12F., No. 178, Sec. 3, Mincyuan E. Rd., Songshan District, Taipei, 105, Taiwan.

2. Please be noted:
  1. Before filing application, it is necessary to download, fill out the mediation application form, and sign or seal it. If an agent is appointed, the agent must also sign or seal.
  2. At the bottom of the mediation application form, please read and sign or seal the "Notice and Consent Form of Collection, Processing, and Utilization of Personal Data by Securities and Futures Investors Protection Center" (minors must have their statutory agent co-sign). If an agent is appointed, the agent must also sign or seal.
  3. Relevant written notices from SFIPC will be sent by registered mails. Please ensure that the application form includes an address and contact information such as telephone number and mobile phone number for immediate delivery of significant documents.
  4. Documents submitted for the mediation application, such as the mediation application form, the power of attorney, consent from the statutory agent to appoint another person as a sole agent, and other relevant evidence or materials related to the case, shall be provided by scanning into PDF format or photos. The content of the files shall be clearly identifiable.
  5. After submitting the online application, please keep the original application form properly and provide it to SFIPC when attending the mediation meeting. If an agent is appointed, the original power of attorney shall also be provided.
